    • A 50% deposit is required to reserve the date. Payment can be made via check or credit card via square. (The balance is due 24 hours prior to the photo session/event/proposal.)

    Planning and Coordination:

    • We take care of all the proposal arrangements, including location scouting, permits (if needed), and logistical details. Our goal is to create a stress-free environment, so you can focus on the moment.

    Photography Session:

    • On the day of the shoot, simply show up and enjoy the experience. Whether it's a proposal, engagement, or wedding, we discreetly capture genuine moments, ensuring your story is authentically told through our lens.

    Post-Production:

    • Our meticulous post-production process involves editing and standard image enhancement to bring out the beauty and emotions captured during the session.

    Delivery of Memories:

    • Once the editing is complete, we deliver a collection of stunning, high-quality images that beautifully preserve the essence of your special moments via a digital download link.

    Throughout the entire process, our commitment is to make the photography experience seamless and enjoyable.   • Yes, to reserve the date/time for your surprise engagement proposal, wedding, or photography session a 50% deposit via square is required. Our availability is very limited, please reserve your session as soon as possible.

  • Absolutely! Once your deposit and the date is locked in, we will help you pick out the perfect spot for your proposal or photo session in Hawaii. We're here to make your proposal experience top-notch, and we can't wait to collaborate with you to make it just right!

    • Surprise Engagement Packages: 60-90 minutes before the Proposal.

    • Portrait and Wedding Packages: 15-20 minutes before the photo session.

  • Definitely! Tell us your vision for the perfect proposal and whether its a bottle of bubbly, a rose petal heart in the sand, or a couture flower bouquet, we would love to work with you on making it a reality!

  • While we are coordinating we will agree on a designated meeting location. A map may also be sent via email or text to clarify the location.

  • Butterflies. Remember the first time you asked someone out or touched their hand? It’s nerve-wracking, heart-pounding, and adrenaline-rushing! Growing in love and processing building a lifetime together is a big step, but is such a beautiful thing. It’s a whole new level in your relationship where you take your love to the next level.

    • In the case of camera failure, inclement weather, or any other unforeseen incident that prevents Jolene Kaneshige Photography (JKP) from shooting on a scheduled date a new date will be scheduled. The client’s deposit will be applied towards the rescheduled date.

    • No refund will be given under any circumstances if you fail to attend the activity on the day and at the time listed, when the booking was made.

    • Due to the nature of digital photography and the fact that photographs, once sent, cannot be returned; JKP has a strict NO REFUNDS POLICY. Once a transaction has been completed (i.e., the buyer selected and paid for the photo and then JKP sent the buyer the photographs) it is then considered non-refundable.

    • Refunds will NOT be given due to “not liking a photo.” If a mistaken photo is sent to the buyer, as documented on the invoice, JKP will send the correct photo to the buyer free of charge.

  • In the following Terms and Conditions:

    • Business” shall mean Jolene Kaneshige Photography (JKP);

    • “Client(s)” shall mean “You” the Parties to the Contract;

    • “Event” shall mean the photography and associated products and services detailed in the 'order booked' section;

    • “Photographer(s)” shall mean JKP assigned photographer;

    • “Products” shall mean any add-ons, albums, or other items listed;

    • “Services” and “Package” shall mean photography to be carried out at the Event and any other Services agreed between the Client(s) and the Photographer and set out in the Contract.

    Entire Agreement:

    • This agreement represents the full understanding between the Photographer(s) and the Client(s), regardless of who pays for the services.

    • It overrides any previous agreements between the parties. Any changes to this agreement must be made in writing and signed by both parties. If any part of this agreement is found to be invalid, the rest of the agreement still applies.

    • If one party does not enforce a part of the agreement, it does not mean they waive their right to enforce it later.

    • This agreement includes all terms between the parties, and any changes must be agreed upon in writing by both sides.

    • Both parties confirm that they are entering into this agreement based only on what is written here and not on any prior statements or promises.

    • JKP is not responsible for any injuries (including death) to anyone at the event, nor for any theft or lost items during the event. JKP is also not responsible for any items falling during a photoshoot shoot.

    • By purchasing our services, you acknowledge that you have read and agreed to the Terms and Conditions. Jolene Kaneshige Photography (JKP) may update these terms without notice, and your continued use of our services implies acceptance of any changes.

    Payments

    • A non-refundable 50% booking fee is required to reserve a date for our services. Payments can be made by cash, credit card, Venmo, PayPal or other methods discussed with JKP. The booking fee is non-refundable and cannot be transferred if the Client cancels less than 24 hours prior to the event.

    • After paying the booking fee, the remaining balance is due 24 hours before the event. Any additional charges for images or products must be paid when ordered. Failure to make payments on time may lead to cancellation. No photos or albums will be delivered until all payments are made in full.

    • If someone else is making the payment, the Client is still responsible for any remaining balance.

    Customer Requirements

    • JKP’s services are available only to, and may only be used by, individuals who are eighteen (18) years and older who can form legally binding contracts under applicable law. You represent and warrant that you are at least eighteen (18) years old and that all registration information you submit is accurate and truthful.

    Services And Vendors

    • JKP conceives, develops, arranges and schedules photography packages (Proposal Packages, Wedding Photography, Family Portrait Sessions, and Real Estate Photography Sessions.) using certain unaffiliated, third-party vendors to fulfill the activities included in each particular package. You understand and acknowledge that the information listed on this website related to each package, including durations, activity descriptions, photographs, and images are for informational purposes only, and are not meant as complete or accurate representations of the packages. If you have any questions as to the nature or substance of any particular packages, please contact us for clarification.

    • Each of the vendors used in connection with the photography packages employ their own rules, conditions, waivers and other obligations with which each of its participants must comply, including dress code, footwear and alcoholic beverage consumption restrictions. You hereby agree to abide by such rules, conditions, waivers and other obligations of the vendors. You understand and acknowledge that the vendor has complete oversight over your person and property throughout your participation in any activity coordinated by such vendor and as such release us from all liability related to activities that are wholly under such vendor’s control.

    Substitution

    • In the unlikely event that the assigned Photographer is unable to attend your Event due to unforeseen circumstances, JKP reserves the right to appoint another suitable Photographer(s) to attend the Event on our behalf to undertake the photography to his/her best ability.

    Scheduling And Cancellation

    • We will try to accommodate your preferred schedule for each activity, but availability depends on the vendor and is not guaranteed for any specific day or time. You will receive an electronic confirmation of your reservation with the date and time of your Package. 

    • If there is a hurricane or severe weather, we will reach out to reschedule.

    • JKP reserves the right to cancel a scheduled Package for any reason. If this happens, we will notify you to reschedule. Please note, you will not receive a refund, but you can reschedule for another date and time. 

    Refund Policy

    • If you miss your scheduled appointment and haven’t rescheduled with us, the Package will be forfeited, and any payments made will not be refunded.

    • In the case of camera failure, inclement weather, or any other unforeseen incident that prevents JKP from shooting on a scheduled date a new date will be scheduled. JKP does not offer refunds for any Packages once payment has been received.

    Ownership 

    • All images shall remain the sole property of the Photographer(s) at all times. All completed albums and products shall remain the property of the Photographer(s) until full payment is received. 

    Liability 

    • The Photographer will take all reasonable steps to ensure equipment is in good working order, backup equipment is available where appropriate and that images are backed up in a responsible manner. In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss. 

    Copyright 

    • Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files, or printed documentation relating to such images are protected by the Copyright and Design Act 1988 and remain the copyright of The Photographer(s) at all times unless there is express written agreement to the contrary. It is contrary to the Act to copy or allow to be copied photographically, electronically, or by any other means an image created as part of this contract without the written permission of the Photographer(s).

    • The client understands and agrees that the photographer is required to retain copies of the photos that were presented to the client from the shoot for 60 days after the shoot.  After this period has expired, the photographer has no duty to retain copies of files or photos from the event. RAW images are never given to the client. It is the responsibility of the client to purchase, store, and backup photos after the 60-day period.  

    Edits

    • Edits made to images are determined by editor creativity.  No body modifications will be done to any client or person in the photograph (you are perfect the way you are).

    Code Of Conduct

    • By purchasing a Package, you agree that you will conduct yourself in an appropriate manner throughout the course of your participation in the activities that comprise the purchased Package. You agree that you will not engage in activity or behavior that: is defamatory, abusive, harassing, threatening, or an invasion of a right of privacy of another person; (b) is bigoted, hateful, or racially or otherwise offensive; (c) is violent, vulgar, obscene, pornographic or otherwise sexually explicit; or (d) otherwise harms or can reasonably be expected to harm any person or entity; violates the rules or codes of conduct of the vendor, as displayed or explained to you by such vendor, including excessive intoxication or consumption of alcoholic beverages when consumption of alcoholic beverages is expressly forbidden by the vendor; is illegal or encourages or advocates illegal activity or the discussion of illegal activities with the intent to commit them, including drug dealing and/or drug abuse, harassment, theft, or conspiracy to commit any criminal activity; andis commercial, business-related or advertises or offers to sell any products, services or otherwise (whether or not for profit), or solicits others (including solicitations for contributions or donations).

    • We cannot and do not assure that other participants are or will be complying with the foregoing Code of Conduct or any other provisions of these Terms and Conditions, and, as between you and us, you hereby assume all risk of harm or injury resulting from any such lack of compliance.

    Assumption Of Risk

    • During the course of your participation in any Package, you may face certain risks and hazards, both foreseeable and unforeseeable. These risks and hazards include, but are not limited to, the following: travel and navigation in difficult terrain and inclement weather; inadequate or unhealthy food and/or water supplies; accidents or collisions involving planes, trains, automobiles, or other modes of conveyance; acts of terrorism, vandalism or war; storms, earthquakes or other natural disasters; government restriction or regulation; theft or other criminal acts; and accident or illness in remote locations without access to medical facilities. These risks and hazards may result in serious physical injury, sickness or death, and damage to, or loss or destruction of property, and no guarantee can be made that JKP or others can provide assistance if any of the forgoing result. You hereby acknowledge that your participation in a Proposal Package involves inherent risks of physical injury, illness, death and/or damage to or loss of property, that your participation is entirely voluntary and that you elect to assume all such risk and participate in the Proposal Package activities with full knowledge of the inherent risks.

    Indemnification

    • You agree to indemnify, defend and hold JKP, its subsidiaries, affiliates, officers, agents, employees and partners harmless from any liability, claim, demand, administrative action, cause of action, suit, damage, loss, cost or expense, including reasonable attorneys’ fees, made by any third party due to or arising out of any content or information you submit, post, transmit, modify or otherwise make available on this website or to third parties with whom you are in contact via this website, including but not limited to any confidential information, your violation of this Terms and Conditions, or your violation of any rights of another.

    Remedies

    • Your sole remedy for a breach of this agreement is an action at law for damages. You waive any right of rescission or to injunctive or other equitable relief.

    Limitation Of Liability

    • Except as specifically stated in this agreement, JKP makes no warranties, either express or implied, including but not limited to any implied warranty of merchantability or fitness for a particular purpose. JKP also does not guarantee that you or your property will not be damaged or harmed while using our services.

    • In no event will JKP or its affiliates be liable for:

    • Any special, incidental, or consequential damages;

    • The cost of obtaining substitute products or services;

    • Any amounts exceeding the fees you have paid to JKP under this agreement during the twelve (12) months before the issue arose.

    • JKP is not liable for any failure or delay in service due to circumstances beyond its control. However, this limitation does not apply where prohibited by law.

    Force Majeure

    • Neither JKP nor the vendors used by us in the delivery of our Packages shall be liable due to causes beyond the control and without the fault or negligence of such party. Such causes may include, but are not restricted to, acts of god or of a public enemy, acts of the government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, freight embargoes, power failure, or failure of the U.S. postal system, but in every case the failure to perform will be beyond the control and without fault or negligence of the party failing to perform. Such party will inform you of any Force Majeure event as soon as practicable after its occurrence

    Americans With Disabilities Act

    • JKP makes no warranty or representation as to whether or not the activities comprising our Packages comply with the Americans with Disabilities Act (ADA) or any similar legislation. In the event that you require accommodation, please contact us in advance to ensure that such accommodation may be made, if possible.

    Disclaimer

    • The information on this website is provided "as is," without any warranties, either express or implied. Neither we nor any third parties guarantee the accuracy, timeliness, performance, completeness, or suitability of the information for any specific purpose. You acknowledge that the information and materials may contain errors or inaccuracies, and we are not liable for any such issues to the fullest extent allowed by law.

    • Your Use Of Any Information Or Materials On This Website Is Entirely At Your Own Risk, For Which We Shall Not Be Liable. It Shall Be Your Own Responsibility To Ensure That Any Products, Services Or Information Available Through This Website Meet Your Specific Requirements.

    Miscellaneous

    • JKP’s rights under this Terms and Conditions may be assigned. These Terms and Conditions shall insure to the benefit of the parties and their successors, administrators, heirs and assigns. These Terms and Conditions shall be interpreted under the laws of the State of Hawaii applicable to contracts entered into and fully to be performed therein. No waiver of any term hereof shall be deemed to be continuing or be deemed to waive any other term hereof. Unless the parties have a written agreement signed by each of them that governs the relationship between the parties, this Terms and Conditions constitute the entire understanding of the parties concerning the subject matter hereof; all prior negotiations and understandings are merged herein. If there is a conflict or contradiction between the provisions of these Terms and Conditions and any other relevant terms and conditions, policies or notices, the provisions of these Terms and Conditions shall prevail in respect of your use of this website. Unauthorized use of this website may give rise to a claim for damages.

    Privacy Statement

    • JKP is committed to the protection of your privacy, and will treat all of the information you provide to us with the utmost respect. JKP works diligently to ensure that it has taken all appropriate administrative and technical measures to prevent the unauthorized or unlawful use of your personally identifiable information, and to prevent any accidental loss or destruction of, or damage to, such information. JKP will only share the information you provide with its employees, agents, processors and third-party payment vendors as necessary to complete the services requested by you. We will not sell or disclose personally identifiable information about you to unaffiliated third parties except in accordance with this Privacy Policy.

    • E-mail messages are not secure. Our security software does not encrypt e-mail messages. E-mail messages traveling through the Internet are subject to viewing, alteration, and copying by potentially anyone on the Internet. You should exercise discretion with respect to the submission of any personal or financial information via e-mail. If you are concerned about the security of your communication, we encourage you to send your correspondence through the postal service or use the telephone to speak directly to us. We are not responsible for the security or confidentiality of communications you send to us through the Internet using e-mail messages.

    • We do not monitor or review the content of other party’s websites which are linked to from this website. JKP is not responsible for the privacy practices or content of such third-party websites. JKP is not responsible for any loss or damage in whatever manner, howsoever caused, resulting from your disclosure of information to third parties with which you have come into contact via this website.

    Complaints

    • All complaints should be raised by the Client directly to the Photographer in writing within 7 days of the occurrence which gives rise to the complaint. The Photographer will consider the complaint and shall provide a response to the Client within 7 days of receipt of the Complaint.
